Indie Developer Lab announced, coinciding with WWDC for those turned away

iOS developers on the west coast might be just a little bit peeved that WWDC sold out before they were even awake, and even more may have been cut out from the fun today as Apple canceled some tickets. Luckily, another event called the Indie Developer Lab has been put together for the same time (June 11 - 14) and only a few blocks away from the Moscone Center at The Box (it's fancier than it sounds). Tickets are considerably cheaper at $100/day as an early bird special, compared to $1600 for the whole four days at WWDC.

Report: Microsoft revealing Xbox 'Woodstock' music service at E3

We are stardust. We are golden. And we've got to get ourselves back to the Xbox. According to some anonymous-type sources over at The Verge, Microsoft is set to continue its shift away from Zuneland into the world of Woodstock -- that's reportedly the codename of a new Spotify-like service set to make its debut at this year's E3. According to the reports, the tiny yellow bird of a service will work across platforms (think Windows 8, iOS, Android and, of course, the Xbox, amongst others), thanks, at least in part, in part to browser-based functionality. The service is said to be set to launch later in the year, around the same as some key MS operating systems.

Bacteria evolved way to safeguard crucial genetic material

ScienceDaily (Apr. 23, 2012) ? Just as banks store away only the most valuable possessions in the most secure safes, cells prioritise which genes they guard most closely, researchers at the European Molecular Biology Laboratory's European Bioinformatics Institute (EMBL-EBI) have found. The study, just published online in Nature, shows that bacteria have evolved a mechanism that protects important genes from random mutation, effectively reducing the risk of self-destruction. The findings answer a question that has been under debate for half a century and provide insights into how disease-causing mutations arise and pathogens evolve.

"We discovered that there must be a molecular mechanism that preferentially protects certain areas of the genome over others," says Nicholas Luscombe, who led the research at EMBL-EBI. "If we can identify the proteins involved and uncover how this works, we will be even closer to understanding how mutations that lead to diseases like cancer can be prevented."

Mutations are the reason each of us is unique. These changes to our genetic material are at the root of variation between individuals, and between cells within individuals. But they also have a darker side. If it affects an important gene -- for example, rendering a tumour-suppressing gene useless -- a mutation can have disastrous consequences. Nevertheless, protecting all genes from mutation would use up too many of the cell's resources, just like holding all deposits in maximum-security safes would be prohibitively expensive. I?igo Martincorena, a PhD student in Luscombe's lab, has now found that cells evolved a 'risk management' strategy to address this issue.

Looking at 120,000 tiny genetic mutations called single nucleotide polymorphisms (SNPs) in 34 strains of the bacterium E. coli, the scientists were able to quantify how random the mutation rate was in different areas of the bacterial genomes. Their results showed that key genes mutate at a much lower rate than the rest of the genetic material, which decreases the risk of such genes suffering a detrimental mutation. "We were struck by how variable the mutation rate appears to be along the genome," says Martincorena. "Our observations suggest these bacteria have evolved a clever mechanism to control the rate of evolution in crucial areas of the genome."

Using population genetics techniques, the researchers were able to disentangle the effects of mutation rate and natural selection on mutations, settling a long-standing debate in the field. Scientists have long thought that the chances of a mutation occurring were independent of its value to an organism. Once the mutation had occurred, it would undergo natural selection, spreading through the population or being eliminated depending on how beneficial or detrimental the genetic change proved to be.

"For many years in evolution there has been an assumption that mutations occur randomly, and that selection 'cleans them up'," explains Martincorena. "But what we see here suggests that genomes have developed mechanisms to avoid mutations in regions that are more valuable than others."

Observations from studies of cancer genomes suggest that similar mechanisms may be involved in the development of cancers, so Luscombe and colleagues would now like to investigate exactly how this risk-managing gene protection works at a molecular level, and what role it may play in tumour cells.

For many businesses - maybe even most businesses - the contact centre has become thoroughly critical. Contact centres are the channel through which a business interacts with clients, nevertheless also suppliers and other members of the value chain. And as contact centre research has become more sophisticated and more deeply integrated into the corporate back-end systems, the contact centre itself becomes in fact the nerve centre of the business.

There are clearly many lower levels of risk that, nevertheless, could put your contact centre out of action for a period of time. Contact centres can as well be affected by a significant change in the innovation or telecommunications environment, major changes to corporate business processes and large staff changes. By the way, changes in the way the contact centre and its business continuity solution are supported can as well cause instabilities.

The real risks that contact centres face

In order to mitigate the real risks that contact centres face, most companies have some sort of disaster recovery plan in place - nevertheless what they forget is the business continuity element. Disaster recovery plans are typically focused on getting the research up and running, yet business continuity takes a look at how to keep the business in its entirety running. To do that, it's necessary to understand how the business processes themselves would be affected.

The first step is to perform a business impact analysis in order to quantify just what the impact of the contact centre going down would be, and which components are critical. As part of this process, the company needs to consider the maximum period that the centre may be down previously overall organisational viability is affected, and the point to which information must be restored to allow operations to recommence.

It's vital to build an understanding of the business continuity management life cycle. It begins, as noted, with an understanding of the organisation and continues with crafting an appropriate business continuity strategy. Thereafter, one must, clearly, develop and implement the appropriate responses as indicated in the strategy.

The final and critical element is that the business continuity plan must be reviewed and tested regularly. This should be done for the time being twice a year, on the whole. Simulation exercises can be used, however there must as well be procedures in place for moving staff to the disaster recovery location - whether it be by plane or vehicle, or even, in Gauteng, by the Gautrain. These plans need to be regularly tested to make sure they work in practice.

This cycle must at the time be repeated afterwards each review is complete. Thus, business continuity management becomes embedded into the corporate culture - and your contact centre has the appropriate level of protection to ensure that a catastrophe doesn't derail your business.

Netflix Beats Q1 2012 Expectations, Reports Losses Of $.08 Per Share On $870 Million In Revenue

NetflixBuilding4Netflix just released their Q1 2012 earnings report [PDF], and managed to beat analyst estimates by reporting losses of $0.08 per share on $870 million in revenue. In the weeks leading up to the release, analysts projected a net loss of $0.27 per share on $866 million in revenue thanks to the company's pronounced push for international growth. That works out to a $5 million net loss for the quarter, though the brass are preparing themselves for better days to come. According to their release, CEO Reed Hastings and CFO David Wells expect to return to global profitability next quarter, and are gearing up for their launch in a still-unknown new European market in Q4.

Is it really an iPad 4G if it can't connect to a 4G network?

In Australia, Apple is defending the 4G designation on its new iPad, despite complaints from the?Australian Competition and Consumer Commission.

In Australia, Apple brands its top-selling tablet the "iPad Wifi + 4G," a designation that seems to imply that the device will connect to a 4G signal. But as the Australian Competition and Consumer Commission recently pointed out, the iPad is not actually compatible with any of the 4G networks down under. This week, the issue made its way to an Australian federal court, which will decide whether or not Apple misled consumers.?

According to the Australian newspaper, Apple has already agreed to issue refunds to shoppers who expected the new iPad to connect to the 4G network provided by local provider Telstra. But the company promised to fight the allegations from the Australian Competition and Consumer Commission, and refused to remove the 4G moniker from the device.?

The phrase 4G, Apple said in a statement, "conveys to consumers in Australia that the iPad with WiFi + 4G will deliver a superior level of service in terms of data transfer speed (consistent with accepted industry and regulatory use of that term), and not that the iPad with WiFi + 4G is compatible with any particular network technology promoted by a particular mobile service provider in Australia."

In other words, 4G is not a matter of any specific network, but a matter of speed.?

In a smart post over at ZD Net, Zack Whittaker breaks down the reason the iPad won't work on 4G networks outside the US and Canada.?

The new iPad, he writes, only works "on the 700Mhz and the 2100Mhz bands of the mobile spectrum. Other countries have already allocated their wireless spectrum to other things ? like in the UK, the 700Mhz band is reserved for free-to-air digital Freeview television, and similarly in Australia, the band is used for analogue television.?UK customers are doubly out of luck, because the wireless spectrum designated for?4G LTE services hasn?t been divided up yet."?

Rove-linked super PACs raise $100 million

Karl Rove (Tony Gutierrez/AP)Conservative super PACs linked to former Bush adviser Karl Rove have raised nearly $100 million so far this election cycle?including $49 million during the first three months of this year alone.

Jonathan Collegio, a spokesman for American Crossroads and its sister group, Crossroads GPS, tells Yahoo News the pro-Republican groups will report raising a combined $99.8 million in financial reports filed with the Federal Election Commission Friday.

The groups plan to raise at least $240 million ahead of November?with most of that money being targeted toward defeating President Barack Obama this fall. Already, they have spent more than $1 million on ads attacking Obama's record on the economy.

The Crossroads groups, early members of the so-called "shadow GOP," spent $70 million in the final months of the 2010 election, when they first emerged on the fundraising scene. The groups are expected to be among the biggest players in the 2012 campaign because there are no legal limits on what the PACs are allowed to raise and spend on the upcoming election.

A key distinction between the committees is that American Crossroads, a so-called "527" political group, is required to disclose its donors to the FEC while Crossroads GPS, a 501(c)(4) group, is not.

The Crossroads groups are expected to play a major role in boosting Mitt Romney's campaign, given that the presumptive GOP nominee enters the general election at a major cash disadvantage to President Obama.

According to Collegio, American Crossroads will report just over $24 million cash on hand as of Mar. 31?more than twice as much as Romney had, according to his campaign. The group declined to say how much Crossroads GPS has in the bank.

It's Time to Protect Your Family and Your Future - New York elder law

Estate planning is a financial process that can protect you and your family, and is a very important component of your overall financial planning. April is National Financial Literacy Month to put your estate planning house in order. If you don?t have an up-to-date estate plan and you happen to get hurt or sick and cannot manage your financial affairs, the courts will have to appoint someone to manage them for you. The person they appoint might not be the one you would want to perform those tasks.

Without an estate plan when you pass away, your affairs will be settled by default through a complex legal system called ?probate.? The handling of your financial affairs can turn into a costly and frustrating ordeal for your family and heirs.

The crafting of a good estate plan starts with planning, followed by the proper drafting and signing of appropriate legal documents such as wills, trusts, buy-sell agreements, durable powers of attorney for asset management, and an advanced health-care directive or health-care power of attorney. Having these documents in place saves you and your family a lot of money and time at a very difficult and emotional time.

Your estate planning should also address the coordination of the way you hold title to your various assets, your beneficiary selections, and the possible transfer of certain assets while you are alive.

Regardless of the extent of your net worth, estate planning is important for everyone. Complex strategies may be used by wealthy people to reduce death taxes and costs. Others may only require a simple will and/or trust to pass on property to their heirs and provide for minor children.

Even if a simple will is all you require, an estate plan is an essential part of your financial planning. Everybody will need it someday. The time to address or update your estate plan is now.

CHECKLIST ? SIX STEPS TOWARD SUCCESSFUL ESTATE PLANNING

1. DEFINE YOUR GOALS: What do you want to happen to your assets in the event of your death or disability? If your beneficiaries predecease you, who are your alternate selections? How will your assets be distributed, and when will these distributions take place?

Decisions on distribution of your estate assets should take into account the size of the estate, the ages and abilities of your children, and your personal desires. For example, a distribution to children over time might consist of 10 percent of the estate at age 18, 25 percent at age 21, 50 percent at age 24 or upon completion of college, and the balance at age 30.

Choose your appointees for important roles: Who will be your executor and, if applicable, trustee and/or guardians? It is advisable to list at least a first and second alternate for each appointment in case your first choice is unwilling or unable to serve.

If you have children who are minors, the appointment of a guardian is probably the most important decision you?ll make. With the court?s approval, this person, or persons, will raise your children. Consider appointing a family member and spouse, or another close couple who?ll care for your children the way you would want.

You may want to consider listing multiple executors, trustees and guardians to serve together in handling the details of your estate. This can provide a check-and-balance system for the appointees and help them avoid oversights or misappropriations. Consider appointing family members, friends, professionals, advisers and/or trust companies for this position.

There is some risk here: If these people disagree and have problems, they can each be represented in court by counsel paid for by your estate, so be very careful in making your selections.

Living trusts have become popular because less administration is required in comparison with a will. Be aware that having a living trust does not eliminate the need for a will and administration at either the first or second spouse?s death.

To get the benefits of the trust, certain details must be attended to, and this is the job of your appointees. For example, leaving a trust for the surviving spouse requires that the trust be funded properly and in a timely manner at the first death, or major tax benefits can be lost.

Is estate privacy an issue for you? Do you want your estate to be public record upon your death? Do you have any special gifts you want made to charity? Do you want an elderly parent or friend to be financially cared for? All of these circumstances should be noted in your plan.

2. GATHER & ORGANIZE YOUR DATA: There are three basic tasks to be accomplished:

  • Review and update your financial position.
  • Review how you hold title to your assets. Is it consistent with your estate plan?
  • Review your beneficiary selections. Are they aligned with your estate plans?

Did you know that how you hold title to assets has a higher legal priority than your will? For example, if you and your best friend held title to an investment club account as joint tenants and you died, the property would revert to your friend even though you had willed your interest to your spouse.

3. ANALYZE YOUR SITUATION: Start by determining your current net worth, assuming your death occurred today. This can be done by totaling your current assets and liabilities, and adding the value of any life insurance.

Try sketching a picture or flow chart of your existing estate plan. Review your appointees:

  • Guardian of the Person/of the Property
  • Power of Attorney ? Property Management
  • Advanced Health-Care Directive or Health-Care Power of Attorney

ESTATE PLANNING ALERT : On December 17, 2010, President Obama signed the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 (The 2010 Tax Relief Act) into law. Estate and gift tax laws have been reinstated along with many new temporary estate and gift tax provisions that will end on December 31, 2012 unless Congress extends or makes them permanent.

Estate Tax Exclusion & Top Rates:? Establishes an estate exclusion amount at $5 million and the top estate tax rate at 35%; indexes the $5 million exemption for inflation for decedents dying after 2011.

Portability:? Beginning for taxpayers dying after Dec. 31, 2010 the estate tax exclusion becomes ?portable? between spouses. This means that the surviving spouse?s exemption is increased by any exemption not used at the first spouse?s death.

Check with your financial advisors for updated information.

4. DEVELOP YOUR STRATEGIES: With the assistance of your estate planning advisor(s), identify the legal documents that need drafting or make any necessary adjustments to existing documents. Determine any other actions that must be taken for your wishes to be carried out.

5. IMPLEMENT YOUR PLAN: Do what needs to be done ? i.e., create new wills, trusts and powers of attorney, adjust title to your properties, change alternate beneficiaries of retirement plans and life insurance policies to trusts.

6. TRACK & MONITOR YOUR PROGRESS: Check your estate plan annually or any time there are changes in your family situation or net worth. Use your financial planning calendar to schedule your next review.
